Government contractors are routinely required to certify compliance with the terms of the contract.  In most contracts with the government, the government contractor has to give the government the “best price” that the contractor would give to any one of its other customers.  The government contractor is required to certify that it has given the government a price that is either less than or equal to the price it gives to its customers.  A government contractor that certifies that it has given the government the best price may be subject to False Claim Act liability.
