Kathleen R. Scanlan is one of the founding attorneys at Keller Grover and brings more than two decades of civil litigation experience to her clients. Ms. Scanlan has exclusively represented plaintiffs for more than 16 years and primarily represents whistleblowers using the Federal False Claims Act (FCA) and state versions of the FCA to expose fraud on the government. Among other cases, she was counsel of record in the matter of United States ex rel Kathy Ormsby v. Sutter Health and Palo Alto Medical Foundation, alleging that the defendants violated the FCA in their Medicare Advantage program. In 2020, she successfully argued against the defendants’ motion to dismiss Ms. Ormsby’s case. In 2021, Sutter settled all claims for $90 Million, one of the largest settlements ever involving a Medicare Advantage provider. Ms. Scanlan has extensive additional experience litigating complex civil cases involving real estate fraud, antitrust and RICO violations, consumer fraud and breaches of fiduciary duty. She has played a pivotal role in Keller Grover cases against a wide array of defendants including Dell, Inc., Tenet Healthcare, Toyota Motor Credit, and 24 Hour Fitness.
Ms. Scanlan is frequently invited to speak to national audiences of attorneys representing both whistleblowers and the government on topics including litigating FCA cases when the government does not intervene, using experts in FCA cases, and trends in FCA enforcement as a result of the government’s response to the COVID-19 pandemic. She is also a member of The Anti-Fraud Coalition (TAF), a non-profit group dedicated to educating the public about the FCA. Ms. Scanlan served as Chairwoman of TAF’s Public Education Committee that created a blog, a podcast and a yearly series called Fraud by the Numbers to educate potential whistleblowers about whistleblower laws and their rights. She continues to volunteer her time to promote and develop special projects to further TAF’s mission to support whistleblowers in their efforts to report fraud.
Ms. Scanlan earned a Bachelor’s Degree in American Studies at Trinity College in Hartford, CT in 1988, and a Juris Doctor degree from the University of California, Hastings College of the Law, in 1998. While at Hastings, she was a member of the Constitutional Law Quarterly and a teaching assistant in the appellate advocacy program. She also received a David E. Snodgrass Intramural Moot Court Competition award for oral advocacy.
Ms. Scanlan is admitted to the Bar in California and Rhode Island. She is admitted to practice before all state and federal courts in California and Rhode Island.
